2. USERS
The access and/or use of this Tef portal attributes the condition of user, that accepts, from this access and/or use, the general conditions of use that are here reflected. These conditions will be of application independently of the general conditions of contracting that in his case result of forced fulfillment.

3. USE OF THE WEB PORTAL
www.tefmontajes.com provides the access to a lot of informations, services, programs or data (from now on, “the contents”) in Internet that belong to Tef or to its licenciantes to which the user can have access. The user assumes the responsibility of the use of the web portal. The responsibility extends to the register that can be necessary to access to some services or contents.
In this register the user will be responsible to contribute truthful and lawful information. As a consequence of this register, we can provide the user with a password. He must be responsable of this password and engage to do a diligent and confidential use of it. The user engages to do a suitable use of the contents and services that Tef offers through his web portal and with enunciative but not limiting character, to not employ them for (i) incur in illicit activities, illegal or contrary to the good faith and to the public order; (ii) spread contents or propaganda that is racist, xenophobe, illegal-pornographic, of apologia of the terrorism or against the human rights; (iii) cause damages in the physical and logical systems of Tef, of its providers or of others, enter or spread in the computer network viruses or any one other physical or logical systems that are susceptible to cause the previously mentioned damages; (iv) try access and, in this case, use the email accounts of other users and modify or manipulate their messages. Tef reserves the right to withdraw all those comments and contributions that infringe the respect to the person dignity, that are discriminatory, xenophobe, racist, pornographic, that attack the youth or the infancy, the order or the public security or that, in its opinion, didn’t result adapted to its publication. In any case, Tef will not be responsible of the opinions poured by the users through the forums, chats or other tools of participation.

4. DATA PROTECTION
Tef fulfils the guidelines of the LOPD 3/2018 de 5 de diciembre de Protección de Datos de Carácter Personal, the Real Decreto 1720/2007 de 21 de diciembre that approves the Reglamento de desarrollo de la Ley Orgánica and other valid rule in each moment, and tries to guarantee a correct use and treatment of the personal data of the user. For this, with each form of collect of personal data, in the services that the user can request to comercial@tefmontajes, it will inform the user about the existence and acceptance of the particular conditions of the treatment of his data in each case, about the responsibility of the file created, the direction of the responsible, the possibility to exercise his rights of access, rectification, cancellation or opposition, the purpose of the treatment and the communications of data to others.
Tef informs too that it gives fulfillment to the Ley 34/2002 11th July, de Servicios de la Sociedad de la Información y el Comercio Electrónico and will request to the user his consent to the treatment of his email with commercial purposes in each moment.
Tef fulfils the guidelines of the General Data Protection Regulation (EU) (GDPR) 2016/649, and especially the express consent that awards the user in the treatment and correct use of his personal data. To such effect, the company has express acceptance forms that necessarily the user will have to validate actively in proof of compliance and express acceptance. Likewise, Tef indicates that it does not gather the circumstances that establishes the European Norm of recent transposition to have the figure of the Delegate of Data Protection.

5. INTELLECTUAL AND INDUSTRIAL PROPERTY
Tef by himself or as an assignee, is the owner of all the intellectual property and industrial rights of his web, as well as of the elements contained in the same (images, sound, audio, video, software or texts; marks or logos, combinations of colours, structure and design, selection of materials used, programs of necessary computer for its operation, access and use, etc.). They belong to Tef or to its licensors.

Based on the articles 8 and 32.1, second paragraph, of the Ley de Propiedad Intelectual, remain on purpose forbidden the reproduction, the distribution and the public communication, included the made available modality, of the whole or part of the contents of this web, with commercial purposes, in any support and by any technician way, without the permission of Tef. The user engages to respect the intellectual and industrial property rights of Tef. He will be able to visualise the elements of the portal and even print them, copy them and store them in the hard disk of his computer or in any another physical support as long as it was, only and exclusively, for his personal and private use. The user won’t be able to suppress, alter, evade or manipulate any device of protection or system of security that was installed in the pages of Tef.

6. GUARANTEES EXCLUSION AND RESPONSIBILITY
Tef is not responsible, in any case, of the damages of any nature that could happen, for example: mistakes or omissions in the contents, fault of availability of the web portal or the transmission of virus or malicious or harmful programs in the contents, in spite of having adopted all the necessary technological measures to avoid them.

7. MODIFICATIONS
Tef reserves the right to effect without prior notice the modifications that it wants in his web portal. It’s able to change, suppress or add so much the contents and services that provides through the web. Also Tef can change the form in which these contents are presented or located in its web portal.

If www.tefmonajes.com had links or hyperlinks to other places of Internet, Tef will not exercise any type of control on these places and contents. In no case Tef will assume responsibility any by the contents of an other website, neither will guarantee the technical availability, quality, reliability, accuracy, amplitude, veracity, validity and constitutionality of any material or information contained in any of the hyperlinks or other places of Internet.
Equally, the inclusion of these external connections will not involve any type of association, fusion or participation with the entities connected.

9. EXCLUSION RIGHT
Tef reserves the right to deny or withdraw the access to web portal and/or the services offered without need of notice it before, to own instance or of an other, to those users that break the present general conditions of use.

10. GENERALITIES
Tef will pursue the breach of the present conditions, as well as any undue utilisation of his web portal, and it will exercise all the civil and penal actions that can correspond it in right.

11. MODIFICATION OF THE PRESENT CONDITIONS AND LENGTH
Tef will be able to modify anytime the conditions that are here determinated, that will be properly published as here they appear.
The validity of these conditions will be standing depending on his exhibition and will be valid until they are modified by others.

12. LEGISLATION AND JURISDICTION
The relation between Tef and the user will govern by the valid Spanish normative and any controversy will be subjected to the courts of the city of Barcelona.
